While all care has been taken by both the seller and the selling agent in collecting the information provided,
neither the agent, online provider nor vendor bear any responsibility as to the accuracy of the descriptions or
the suitability of items for the purchaser’s needs.
We strongly recommend prospective bidders inspect the images and relevant lots in person or appoint a
representative to inspect relevant lots on their behalf before bidding.
The description indicates the lot has an appraisal based purely on an external visual inspection.
There may be other mechanical, electrical, structural, hydraulic damage, or missing parts, including rust that is
unsighted, that will not be contained in the description, and it remains the buyer's sole responsibility to make
enquiries and be satisfied with the condition and state of repair of the lot before bidding.
Images and videos displayed on the website form part of the description of the lot however they should not be
relied upon solely and may not represent any issue or damage to the lot.
All and any references to odometer or hour meter are only what is showing on the odometer or hour meter and
may not be the true odometer or hour meter reading.

SPECIAL CONDITIONS – ELECTRICAL APPLIANCES
All appliances are sold in a used condition unless otherwise stated as new or unused, and no warranty
whatsoever is given that their present condition complies with the safety requirements of the state electricity
commission or that they are otherwise fit for use. It is pointed out that under the state legislation the purchaser
is required before use or resale to have the appliance inspected and repaired by a registered electrical
contractor.
Terms & Conditions
- All bidders must be registered, and by registering you acknowledge and accept the terms and
conditions of Soutar Online Auctions – North Queensland as outlined here.
- The highest approved bidder for each lot shall be the purchaser subject to the approval of the vendor
and the reserve price if any.
- If any dispute arises as to the last or highest bidder, the Auctioneer has the absolute discretion to put
the lot in dispute up again for sale at the highest amount previously bid or to determine the dispute in
any other way the Auctioneer considers appropriate in his or her absolute discretion.
- All lots are sold exclusive of GST unless otherwise stated.
- Vendors not registered for GST will be noted on purchaser’s tax invoice.
- Buyer’s Premium - Purchasers acknowledge that all lots purchased are subject to a buyer’s premium at
a rate displayed within the auction sale details. The buyers premium is exclusive of GST and will be
added to the purchase price of individual lots.
- Full payment must be received within 24 hours following the completion of the auction, in cash or
direct deposit to the Selling Agents nominated bank account.
- If any lot purchased is being financed, a deposit of 10% of the lot value must be paid within 24 hours as
a holding deposit to secure the sale.
- All items must be paid for in full before any delivery is made. No Items will be removed until full
payment has been received.
- All items remain the property of the vendor until full payment has been received by Soutar Online
Auctions.
- All items purchased are the buyer’s responsibility upon the fall of the hammer.
- All lots are sold as is, where is, with all faults if any and without any warranties of any kind.
- All Vehicles and Machinery offered are sold unregistered unless otherwise stated in the catalogue and
do not have statuary warranty.
- Any faults in the goods sold shall not void the sale, but neither the Vendor nor the Auctioneer shall be
bound to deliver more than is in their possession.
- Soutar Online Auctions strongly recommend intending purchasers to personally inspect or have a
representative inspect items prior to bidding to satisfy themselves of that items condition.
- Soutar Online Auctions makes no representation express or implied or gives any warranty as to the
state, condition or suitability of any lot.
Bidders / Purchasers must rely entirely upon their own inspection, searches, enquiries or advice
received as to any matter affecting the lot or any part of it.
Any information given in relation to a lot by the Auctioneer or any agent on there behalf is given and
accepted entirely without responsibility.
- Soutar Online Auctions will not be liable for any loss, damage, cost or expense suffered or incurred by
the Purchaser arising from the purchase of any item at the Auction.
- The Auctioneer may refuse to accept a bid and can withdraw any lots from sale.
- Where a bid has been referred the auctioneer has the right to negotiate with the highest bidder on that
item. Subject to vendors approval.
- The purchaser acknowledges that the Auctioneer is acting as an authorised agent of the Vendor and
any rights of action he may have in respect to the lots purchased by him lie against the Vendor and not
the Auctioneer.
- The purchaser agrees and accepts it is their sole responsibility to abide with the selling agent’s terms
and conditions of sale.
Failure to abide with these terms and conditions of sale will be solely at the purchaser’s risk and the
auctioneer will not be liable for any loss, damage, cost or expense incurred by the purchaser.
- Upon registering to participate in an auction, the purchaser acknowledges they have read and
understood the terms and conditions.
SALE DELIVERIES – TERMS & CONDITIONS
- All items must be paid for in full before any delivery is made. No Items will be removed until full
payment has been received.
- Collection of items must be made within 7 Days of sale unless prior arrangements have been
made with the Auctioneer.
- All items purchased are the buyer’s responsibility upon the fall of the hammer.
- Soutar Online Auctions take no responsibility for any damage to sale items, property or personal
injury during the storage, collection and loading of items from the Auction.
- Items not collected within the allocated delivery period, will attract a storage fee of
$100 + gst per week.
- Loading equipment is generally available for manageable and smaller items onsite during the
delivery period. Loading fees may apply to items falling outside the delivery period.

availability.
- Loading of large and heavy sale items are the responsibility of the purchaser any fees or costs
relating to the hire of loading equipment is the sole responsibility of the purchaser.

- Items not collected within the nominated delivery period will be at risk of being deemed to have
been abandoned and will either be disposed of or resold.
